So my tailgate has stuck open and closed a couple of times but now seems to be in constant stuck mode. This may or may not include the back glass refusing to open or close as well. The "fix" is to move a little rod attached inside the tailgate as part of the door assembly as seen in this video:

My question though, what is the permanent fix? What needs replaced?

There are 2 actuators, one for the glass and the other for the tailgate alone.
Do you have the key fob on yours, will that open release them?
It either an electrical supply fault or the actuator part probably required. Do you have the FSM ?

Most likely the Microswitch inside the gate latch mechanism.
This switch fails due to water penetrating it.....there was a TSB about this put out.

So this needs to be replaced and try to protect it a bit from the elements.

There is also a small microswitch in the tip-up glass mechanism that could need adjusting or replacing.

The Jeep KJ Service Manuals and Parts Fiche are available here..except 2004 and 2007 models.

There are Theory of Operation sections and Section 8W has the Wiring Diagrams.

Yes I can key fob open the liftgate. Ihave FSM's manuals, can't say I've seen anything on that.

could be as simple as dirty switch/latch
On the 05 when I got it used lady said she was quoted 400 and some dollars to repair the back glass/gate
Figured it was simple so talked her down do some other things and the back gate
Took it home, cleaned and lubed the latch/ switch etc and now 4 years later still works as it should.
Try that first, may not be it but easy to see and cheap

Is this on your 2002 KJ ? Look under Body Section- Swing Gate -in the 2002 FSM - Information about The Latch Assembly mechanism can be found in # 23-137
