Is buyer trying to scam me over a Liberty I sold?

Through a friend of a friend who knows I go to auctions, this person asked me to find him an SUV up to $6-7K. I get him a real clean 2007 Liberty with 131K for $4250, his price after my fee. (I'm only making $600 and it took a few trips to the auction to find this one) It runs and drives good and I don't hear from the guy until today, 2 months later. Says he took it in for a brake job and they found it was missing a rear shock. Shop also says the shock mount is missing from the differential and they will have to replace that too. So with parts and labor the shop wrote an estimate for over $2700. I didn't give any warranty so I'm not worried, but say you guys?

I assume you had something that it was sold as is with no warranty , correct?
Nothing much he can do unless you had guaranteed that nothing would happen for the next 6 months, or 60,000 miles and if it did you would cover all costs:shrug:
Did he look it over before he paid you? If so he should of seen the problem
I wouldn't worry.
I have sold over 100 cars / trucks/ 4X4s / Harleys over the last 40 years and made sure everyone knew up front it had a 50 foot or end of the driveway warranty . Of course I checked them all over myself to make sure.

I'm not worried, just want to know if you have to replace the differential if whatever shock mount on it is missing?
No,the part can be sourced from the dealer for a few bucks and most likely a hours worth of labor to weld on since it must be placed correctly,plus prep time.


All said and done should not cost more then $250-$300 for the repair including both rear shocks.

I have a feeling that if you were missing a shock you would notice it before a mechanic had to tell you....

Sorta makes you wonder if they were doing something" stupid " and broke the shock and shock mount. But I cant imagine what it would take to do that.

This seems scam-a-licious to me. The current owner should have inspected, test driven, and agreed that the vehicle was in satisfactory condition prior to handing over $4250.

How would you NOT know that something like that is completely missing from the vehicle?

I would think that you should be able to inspect where the lower shock mount is welded (or supposed to be welded) to the rear axle.. see if it looks like a clean break, with bare metal exposed, or freshly surface rusted. if it's all nasty and looks like it's been that way for a long long time... slightly different take.

I can't even imagine driving one 25 miles without noticing a shock was missing, well even a mile and I'd notice!
But that long , where is Paul Harvey, we need " the rest of the story"

I see cars around here with BLOWN shocks bouncing up and down and I think to myself: "How the hell do they not notice something is wrong?!?!" I couldn't imagine a MISSING shock...

My wife bought a Toyota out of Japan and had it shipped to her in Tanzania. When i got there she complained about " bouncing " and some strange noises in the back. I drove it maybe 1/2 mile and got back and told her what the issues were, blown shocks. Of course I got the standard " are you sure, could it be something else?"
So ordered two rear shocks, there the next day ( faster service in Tanzania than here) and all was good.
But dang hit a small bump and it would bounce for a mile it seemed, not sure how she drove it

I do not know how someone would not notice that. Always worries me about people pulling stuff after a vehicle has been sold so I now put on the bill of sale "Sold as is, Where is with no warranty or guarantee expressed or implied" I know it does not guarantee they wont come back but it will stop them from saying I guaranteed anything. I do not know why people do not check out the vehicles they buy.

Selling a used vehicle is automatically an "as is" sale, unless otherwise stated in writing that you're giving a warranty. But I still put "as is and shown" on the bill of sale, since not everybody knows what the law is.

It depends. A neighbor down the road sold a car of his and a year or so down the road something expensive failed/broke and the buyer ended up suing him and won. "As Is" didn't save him. Not sure of any extenuating circumstances but it happened.

That depends on the state. I know in MA you can get pretty screwed if the buyer doesn't like something within 30 days.

Oklahoma warranty, once the seller can't see the brake lights the warranty is over. If it breaks in half he now has two Liberties - no charge.



2 months later - tell him to pound sand.

I have a bag of sand and a broken off sledge hammer handle in the garage to help settle a buyers warranty claim. :happy175:
Must be a small handful of states that imply a warranty if you don't say otherwise in writing. Wouldn't surprise me if most of them are up dare in the Republik of New England.....and prolly Californi too.
